Terms and Conditions

 

 

  1. Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions. This is a game of skill and chance plays no part in determining the winner.

 

  1. Entry is open to residents of Australia and New Zealand. However, employees and their immediate families of Pacific Magazines Pty Ltd and Edgewater Resort & Spa and their associated agencies and companies are not eligible to enter.

 

 

  1. The competition commences on Wednesday 5 November 2008 at 00:01 (AEDT) and concludes on Friday 30 January 2009 at 23:59 (AEDT).

 

  1. To enter, participants are required to send a completed entry form from the November 2008 edition of Bride To be magazine to Bride to Be & Competition, PO Box 141, Eastern Suburbs MC, NSW 2004 and register their details including name, address, phone number, e-mail address and answer to the question "Why do you deserve to have a luxurious dream honeymoon in the Cook Islands?"

 

  1. Entrants must be over the age of 18 to enter.

 

  1. Incomprehensible and illegible entries will be deemed invalid.

 

  1. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

 

  1. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner's entry is of a type described in this clause.

 

  1. Entries must be received by 23:59 (AEDT) on Friday 30 January 2009. The Promoter accepts no responsibility for any late, lost or misdirected entries.

 

  1. Total prize value is up to $6,615. The best valid entry, as determined by the judges, will receive the following:

 

-         2 return economy airfares including pre-payable airport taxes from the winner's nearest capital city in Australia (excluding Hobart and Darwin) and from Auckland, Wellington or Christchurch in New Zealand to the Cook Islands. It is the winner's own responsibility to find transport to a capital city.

-         5 nights accommodation in a Beachfront Deluxe Suite at the Edgewater Resort & Spa

-         Spa Package including:

- One hour massage for the honeymoon couple

- 1 x Hydrating body treatment

      - 1 x Pacific Body Wrap

-         Island Night Umukai dinner & show

-         Fresh fruit basket and bottle of chilled sparkling wine on arrival

-         Return airport / hotel transfers                                                       

 

  1. Prize cannot be transferred and cannot be redeemed for cash.

 

  1. Entry is not available to people under the age of 18.

 

  1. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value.

 

  1. The Promoter is not responsible for any acts of god, such as adverse weather conditions or industrial action or civil commotion that may occur whilst the winner is travelling. Accommodation is twin share standard room. Travel arrangements to and from the winner's nearest capital city airport (Sydney, Melbourne, Brisbane, Adelaide, Perth, Auckland, Wellington and Christchurch) do not form part of the prize and are the responsibility of the winner and their travelling companion. The winner must travel on the same flights and itinerary as their travelling companion. The travel prize cannot be used as part payment for another airfare package. Frequent flyer miles cannot be accrued on this prize. Flights and accommodation are subject to availability at the time of booking and cannot be exchanged for other destinations. Travel restrictions & blackout dates apply. Prizes cannot be taken during peak periods or school holidays, and the winners must provide all suppliers with a minimum of 30 days advance notice of intention to travel. Embargo restrictions apply during certain periods. Bookings are subject to all suppliers' booking conditions & availability (including but not limited to capacity limitations and other restrictions. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize. The Promoter does not guarantee that the winner will enjoy the travel prize or be suited to the type of travel prize that is offered. 

 

  1. Unless expressly stated in these terms and conditions all other expenses are the responsibility of the winners (and their companions) including but not limited to current passports, visas, meals, spending money, transport to and from departure and arrival points, transfers, drinks, incidentals, mini-bar, laundry, room service, telephone calls, activities, airport taxes (including departure taxes), energy surcharges, gratuities, services charges, travel insurance, pre and post accommodation, optional activities or excursions and all other ancillary costs All taxes (excluding GST and taxes included in the price of the tickets) which may be payable as a consequence of receiving the prize(s) are the sole responsibility of the winner.. A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges. Holidays are subject to flight and booking availabilities. Prize must be taken by the 30th December 2009.

 

  1. By entering the competition, and by collecting a prize, the winner acknowledges and accepts that driving, travel and any other activities comprising the prize, are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. The winner, for themselves and their executors, releases the Promoter, its agents, officers and employees, from any and all legal claims in connection with any death, injury, incapacity, damage to property or other losses arising from or connected with the collection or enjoyment of the prize.

 

  1. Compliance with any health or other government requirements is the responsibility of the prize winner and their travel companion. It is the responsibility of the prize-winner to enquire about local issues and conditions at destinations prior to travel. All prize travel will be subject to the carriers General Conditions of Carriage. The Promoter and carrier make no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including local government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade at www.smartraveller.gov.au. Prizes for travel for a particular event or attraction must be taken to coincide with the event or the times and dates during which the attraction is available.

 

  1. The promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.

 

  1. Once prizes have left the Promoter's premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit. The Promoter, and their related bodies corporate and their respective officers, employees, contractors and agents shall not be liable for any loss, damage or personal injury whatsoever (including but not limited to direct, indirect and consequential loss, and loss arising from negligence) suffered or sustained in connection with the promotion, the promotion of this promotion or the use of any prize, except for any liability which cannot be excluded by law.

 

20.   In consideration for the Promoter awarding the prize to the winner, the winner hereby assigns to the Promoter all right, title and interest in and to all copyright in any material created pursuant to the winner's participation in any aspect of the prize (Works). The winner acknowledges that the Promoter is free to use the Works and to exercise its rights in relation thereto and the winner will not be entitled to any fee for such use.

 

21.   In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner's image and/or voice, as recorded, photographed or filmed during the winner's participation in the prize to appear in connection with this promotion or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.

 

  1. Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.

 

  1. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.

 

  1. One winner will be judged from all entries received throughout the duration of the promotional period by a judging panel at Pacific Magazines at 35-51 Mitchell Street, McMahon's Point NSW 2060 commencing Monday 6 February 2009 at 12pm (AEDT). All decisions of the Promoter are final and no discussions or correspondence will be entered into.

 

  1. The winners will be the best valid entries selected by the judging panel, having regard to skill, creativity and originality. There will be one winner only.

 

  1. The winner will be notified in writing and via the phone.

 

27.   Should an entrant's contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.

 

  1. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier's requirements.

 

  1. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.

 

  1. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter's ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions.

 

  1. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

 

  1. All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this promotion but no further use of this information will be made without prior consent. 

 

  1. It is a condition of entry that the promoter has the right to publicise the names of any contestants for any promotion or matter incidental to the competition. The winners may also be required by the promoter to participate in a photo, video and/or film session and acknowledges that the promoter has the right to use such publicity photos, videos and/or films in any medium (including, without limitation, the internet) and in any reasonable manner it sees fit, unless that person advises the promoter at the time of entering the competition that he/she wishes to retain his/her anonymity. Contestants also acknowledge that their photo may be used for a promotional display at the prize provider's location. Contestants consent to their entry being published.
